We know it's tempting to skip these Terms of Use, but it's
important to establish what you can expect from us as you use
US.Watch services, and what we expect from you.

Welcome to US.Watch, a service operated by Alert Link LLC ("we," "our," or "us"), a company incorporated in the State of Missouri. These Terms of Use ("Terms") govern your access to and use of the US.Watch mobile app, website, and any associated services, including participation in our online communities and social media platforms (collectively, the "Services").

Please read these Terms of Use, Cookie Policy, Privacy Policy, Child Protection Policy, Community Action Disclaimer, Accessibility Statement, and Legal Disclosure (collectively, "Site Terms", "Terms") carefully before using US.Watch's websites (the "Sites"), and our associated app (the "App", "Apps").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

General

The Terms apply exclusively to your access to and use of the Sites, including but not limited to www.us.watch, www.app.us.watch, and form a binding agreement between you and US.Watch. You also agree to be bound by any additional terms that may be posted regarding individual sections of the Sites. Please review US.Watch's Privacy Policy, which also applies to your use of the Sites.

By using the Sites, you agree that (a) all information you submit, if any, is truthful and accurate; (b) you will not submit any personal information if you are under 13 years old; and (c) your use of the Sites does not violate any applicable law or regulation.

Eligibility of App Users

You must be at least 18 years old to use our Apps. By using the US.Watch Apps, you affirm that you are of legal age and authorized to enter into these Terms.

Use of Services

US.Watch is designed to enable members of the public to assist in the search for missing or endangered persons by providing access to real-time enhanced AMBER Alerts and information. Your participation is voluntary and must comply with these Terms and all applicable laws

You may not use the Services to:

Violate any law or regulation.
Trespass or enter private property without permission from an owner.
Engage or confront any suspect or person of interest.
Impersonate another person or provide false information.

All search-related activity is conducted at your own risk. US.Watch does not direct or supervise search operations.

User Accounts

To access certain features, you may need to create an account and provide your full name and phone number. You are responsible for keeping your account information accurate and secure. We may suspend or terminate your account for any violation of these Terms without notice.

Community Participation

You may engage with our community via blog comments, Discord, and social media. You must not post unlawful, threatening, defamatory, or inappropriate content. We reserve the right to remove content or limit your account's engagement at our discretion. You must follow all platform-specific policies, Terms of Service, and Community Guidelines.

Location and Data Collection

By using our app or Service, you consent to our collection of location data, your name, and phone number. We also use cookies on our website. For full details, please refer to our Privacy Policy.

Intellectual Property

Unless otherwise indicated, US.Watch or its partners own all content on the Sites, including without limitation all copyrights, trademarks, service marks, designs, text, graphics, layout, logos, pictures, audio/video clips, information or data (collectively, the "Content"). All Content owned by US.Watch is protected by U.S. and international copyright, trademark and other intellectual property laws.

Unless otherwise identified as a Permissible Use, no Content can be used commercially, resold, redistributed, reproduced, displayed, republished, digitized, translated, modified, publicly performed or used for other than its intended purpose. Additionally, you must refrain from any: (a) derivative use of the Content; (b) use of data mining, robots or similar data gathering or extraction methods or (c) framing, inline linking or mirroring any portion of the Sites.

Nothing in the Terms or Privacy Policy should be construed as conferring in any way any license or right to any of US.Watch's intellectual property rights. US.Watch may terminate your access to the Sites at any time for any reason. You agree that US.Watch shall not be liable to you or any third party for terminating your access to the Sites. Your obligations under the Terms, which by their nature are intended to survive termination (such as indemnification) shall survive termination of your access to the Sites.

Unless otherwise indicated, all Content and technology associated with US.Watch is owned by or licensed to Alert Link LLC.

Trademarks

#SAVEUSKIDS®, SAVEUSKIDS®, USWATCH®, US.WATCH®, ALERT LINK®, WATCHZONE®, EVERY ALERT DESERVES ACTION®, PEOPLE POWER PUBLIC SAFETY®, TRANSFORMING ALERTS INTO ACTION®, REAL-TIME COMMUNITY RESPONSE® and other trademarks, service marks, names, logos or slogans contained on the Sites and owned by US.Watch may not be copied, imitated or used, including any involving metatags or "hidden text," in whole or in part, without the written authorization of US.Watch.

Disclaimer and Limitation of Liability

All content on the Sites is provided on an "as is" basis without express or implied warranty of any kind, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. US.Watch makes no warranty as to the accuracy, completeness or reliability of any content available through the Sites, Apps, or Services, and makes no representation or warranties that use of the Sites will be uninterrupted or error-free.

In no event shall US.Watch be liable to you or any third party for any losses, including without limitation direct, indirect, incidental, consequential or special damages, arising out of or in any way connected with access to or use of the Sites, Apps, or Services, even if US.Watch has been advised of the possibility of such damages.

US.Watch provides information and tools for public assistance in emergency alerts. We do not guarantee the accuracy, completeness, or availability of alerts or user-generated content.

You understand and agree:

You act independently and at your own risk when responding to any alert.
US.Watch is not responsible for your actions during a search or when using our Services.
We do not authorize or encourage users to enter private property, engage suspects, or interfere with law enforcement.

To the maximum extent permitted by law, Alert Link LLC is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Services.

Indemnity

You agree to defend, indemnify and hold harmless US.Watch, its officers, directors, employees, volunteers and agents (collectively, the "Indemnified Parties") from and against any claims, damages, costs, actions, demands, liabilities, settlements and expenses (including without limitation attorney fees) arising out of or related to your access to or use of the Sites, Apps, or Services or your inability to access or use the Sites, Apps, or Services.

Account Termination; Modification or Removal of Content

Notwithstanding any Site Terms, US.Watch reserves the right, without notice and in its sole discretion, to discontinue the Sites or any services offered through the Sites and to terminate your access to the Sites at any time without notice. In addition, US.Watch reserves the right to delete, edit or modify any and all Content contained on the Sites and any services offered through the Sites at any time without notice.

Changes to Terms

We may update these Terms from time to time. Continued use of the Services after such changes constitutes your acceptance of the new Terms.

Governing Law

The Terms and your use of the Sites are governed and construed in accordance with the laws of the State of Missouri, without resort to conflict of law provisions. You irrevocably and unconditionally consent and submit to the exclusive jurisdiction of the state and federal courts in the State of Missouri over any action or proceeding relating to the Terms.
